Welcome to WeCareConnect UG (haftungsbeschränkt). These Terms of Service (ToS) govern your use of our platform (www.wecareconnect.de) and services. By accessing or using our services, you agree to comply with these terms. If you do not agree, you may not use our platform.

1. About Us

WeCareConnect UG (haftungsbeschränkt) is a recruitment agency specializing in connecting nurses with hospitals, clinics, and other medical facilities in Germany. We act as an intermediary under Section 611a BGB, facilitating the conclusion of employment contracts between nurses and employers.

2. Scope of Services

WeCareConnect UG provides services for:

  • Matching qualified nurses with medical institutions;
  • Facilitating the recruitment process, including initial communication and documentation exchange;
  • Advising on compliance with German labor and immigration laws where applicable.

We do not act as an employer, nor do we guarantee employment or hiring outcomes.

3. Legal Basis for the Services

Our services comply with German labor laws, including:

  • Arbeitnehmerüberlassungsgesetz (AÜG): We do not provide temporary staffing under AÜG;
  • Sections 611a and 631 BGB: We facilitate agreements between employers and employees;
  • Datenschutz-Grundverordnung (GDPR): We process personal data strictly in accordance with GDPR and the Bundesdatenschutzgesetz (BDSG).

Employers and nurses are responsible for ensuring their contracts comply with applicable laws.

4. Eligibility

For Nurses:
To use our services, you must:

  • Hold valid nursing qualifications recognized in Germany;
  • Meet the legal requirements for employment in Germany, including visa and work permit regulations;
  • Provide accurate and up-to-date information about your skills, certifications, and work history.

For Medical Institutions:
Employers must:

  • Comply with German labor laws, including providing legally required employment contracts;
  • Ensure fair and transparent working conditions;
  • Provide truthful and accurate job descriptions.

5. Contractual Relationships

WeCareConnect UG acts solely as an intermediary. The employment relationship is exclusively between the nurse and the medical institution.

  • Nurses: You are responsible for reviewing and signing your employment contract with the employer.
  • Employers: You are responsible for adhering to German labor and immigration laws in your contracts with employees.

We are not liable for disputes arising from these employment relationships.

6. Data Protection

WeCareConnect UG complies with GDPR and the German Federal Data Protection Act (BDSG). By using our services, you consent to:

  • The collection and processing of personal data for recruitment purposes;
  • The sharing of your data with potential employers, as necessary for placement;
  • The secure storage of your data within the European Union.

7. Fees and Payments

For Nurses:
Our services are free of charge unless otherwise agreed.

For Employers:
Employers are required to pay placement fees as outlined in a separate service agreement. Fees are due upon the successful hiring of a candidate unless stated otherwise. All fees are non-refundable unless otherwise specified.

8. Liability

WeCareConnect UG’s liability is limited as follows:

  • We are liable for damages caused by intent or gross negligence in accordance with Section 276 BGB;
  • We are not liable for damages arising from the employment relationship between nurses and employers;
  • We are not liable for incomplete or inaccurate information provided by either party during the recruitment process.

This limitation of liability does not affect mandatory statutory rights under German law.

9. Termination and Suspension

We reserve the right to terminate or suspend your access to our platform if you violate these Terms or applicable laws. You may terminate your use of our services at any time by providing written notice.

10. Governing Law and Jurisdiction

These Terms of Service are governed by the laws of Germany. Any disputes arising out of these terms will be resolved in the courts of Düsseldorf.

11. Changes to the Terms

We may update these Terms of Service to reflect changes in legal requirements or our services. The latest version will be posted on our website. Continued use of our platform constitutes acceptance of the updated terms.
